1.1 Introduction

1.2 We are Mc Laughlin’s Fresh Fruit & Vegetable Wholesale Limited trading as Season Harvest (“Season Harvest”), a Northen Irish registered company (number NI036449). Season Harvest is registered for VAT. Season Harvest’s trading and registered office is at 613b, Baranailt Road, Claudy, L'Derry, BT47 4EA.

1.3 Season Harvest own and operate this website.

1.4 These terms and conditions (T&Cs) comprise a contract between you and Season Harvest governing the use of this website. If you are a consumer your statutory rights are not affected by this agreement.

1.5 References to “goods” in these T&Cs include “services”. Headings are for information only and are not binding.

1.6 Season Harvest may update these T&Cs from time to time and any changes will be notified to you via the email address provided by you on registration or via a suitable announcement on our website. The changes will apply to the use of the website after Season Harvest has given notice. If you do not wish to accept the new T&Cs you should not continue to use the site. Your use of the website after the date on which the change comes into effect indicates your agreement to be bound by the new T&Cs.

When you place an order with Season Harvest, you agree to accept the following terms and conditions.

2. Making A Purchase
2.1 Season Harvest aims to deliver goods of the highest quality. Every effort is made to display only items that are in stock or which can be dispatched to you. From time to time Season Harvest may be unable to meet our usual delivery times due to certain items being unavailable, in which case Season Harvest will advise you immediately. If this does occur, you will be given the opportunity to 1) order an alternative, 2) have the products sent as soon as they become available or 3) to cancel the order.

2.2 All prices quoted are in British pounds sterling (£) and where appropriate include Value Added Tax (VAT) at 17.5%. Season Harvest make every effort to ensure the prices are accurate, however changes beyond our control do occasionally occur. If this happens Season Harvest will contact you before shipping your order to gain your agreement to the revised price or to amend or cancel the order.

2.3 Orders are accepted at the sole discretion of Season Harvest and are subject to your credit or account card being authorised for the transaction. All transactions are conducted through a (website link here). Season Harvest accept Visa, Delta, Electron, MasterCard, American Express, Laser, Maestro, Solo, Switch via a secure web server.

2.4 You will receive a confirmation email within 24 hours of your order being placed. This will include your order number, Season Harvest’s contact details, a full list of the products you have ordered and all costs.

2.5 Every effort is taken to ensure that the information contained in this web site is correct and up to date. However, Season Harvest disclaims all warranties and representations as to the accuracy of any information contained if at any time it becomes inadvertently out of date or incomplete. Season Harvest cannot be held responsible for any loss or damage that may arise from the use of this information.

3. Registration
3.1 You must be 18 years to register on this website. You must supply Season Harvest with correct information on registration and promptly notify Season Harvest of any changes.

3.2 The username and password selected by you on registration are personal to you and are not transferable. You are responsible for keeping them secure and for any use of the website including order made by anyone using your username and password.

3.3 You must protect against unauthorized access to your computer. Ensure that you sign off when you finish using a shared computer.

3.4 Any breach of security concerning your username and password should be notified to Season Harvest immediately.

3.5 Season Harvest may in our discretion suspend or terminate your registration or use of this site without notice and without giving reasons.

4. Delivery Schedule
4.1 Check our delivery schedule for delivery days in the area (delivery schedule link), if there is likely to be a delay Season Harvest will inform you as soon as possible. Season Harvest aim to deliver as per our delivery schedule. Orders placed after 12pm on Thursday, any time on Friday, Saturday or Sunday are not packed until Monday at the earliest, so your goods will be delivered on the next scheduled delivery day for your area.

4.2 Goods shall be supplied where appropriate by Season Harvest in its own crates which shall at all times be and remain the property of Season Harvest. Season Harvest’s crates shall be returnable at any time on the demand of Season Harvest and may also be collected by Season Harvest from you on demand. A fee of stg£5 shall be charged for any lost or damaged crates and where any crate is not returned when return is requested by Season Harvest pursuant to this clause 4.2. 

5. Tax Charges
5.1 All prices are shown in UK pounds and are inclusive of VAT.

6. Credit Card Security
6.1. Your credit/debit card details are entered on a (merchant name) Secure ePayments web server with 128bit encryption. Click the padlock symbol in your browser for details of the encryption. Season Harvest accept Visa, Delta, Electron, MasterCard, American Express, Laser, Maestro, Solo, Switch.

9.Complaints Procedure
9.1 Season Harvest endeavour to respond to all complaints within three working days. Please email (sales@seasonharvest.co.uk) or call Season Harvest on 02871338478. If for any reason Season Harvest cannot resolve your complaint immediately Season Harvest will advise you on how long Season Harvest expect it will take and keep you fully informed throughout the process.

10 Instability of the Internet
10.1 The internet is an inherently unstable medium. Season Harvest do not guarantee uninterrupted or error-free service and accept no responsibility in respect of such interruptions or errors.

10.2 Season Harvest do not guarantee that this site will operate either fully or in part on any specific computer equipment or in any specific software or that it is free from viruses or anything else which may have a harmful effect on any technology.

10.3 Season Harvest reserve the right to suspend the website without notice for repair, maintenance or other technical reasons. 

11. Returns Policy
11.1 Season Harvest want you to be 100% satisfied with your order. So if you are unhappy with your goods for any reason, you can return any item in its original condition, and you must report to Season Harvest within 24 hours of receipt for a replacement or a full refund.

11.2 You also have the right to cancel your order within 24 hours before receipt without giving a reason and return the goods to Season Harvest for a full refund. Any refunds will be made within 30 days of cancellation. Your statutory rights are not affected.

12.1 Descriptions and other information concerning particular goods: The information on this site is intended to be useful and informative for customers of Season Harvest. Season Harvest will use reasonable care to ensure that the information is accurate at the time it is added on the site.

12.2 Please note, however, that Season Harvest cannot guarantee the information is accurate and Season Harvest shall not be liable for any losses or damage that anyone may suffer as a result of relying on this information. The information may be changed by Season Harvest at any time.

12.3 Other information on the website: Season Harvest use reasonable efforts to include accurate and reliable information on this site but make no promise to this effect. Such information is used or relied upon at your own risk.

12.4 If you inform Season Harvest of any inaccuracies on the website, Season Harvest will attempt to correct them as soon as Season Harvest reasonably can.

14.1 The content of our website including without limitation all information, software, data, text, photographs, graphics, sound and video are protected by copyright, trade marks, service marks, patents or other property rights.

14.2 Except insofar as expressly permitted in these terms and conditions, the content of this website may not be retrieved, displayed, modified, copied, printed, downloaded, sold, hired, reverse engineered or transmitted in any way without the prior written consent of Season Harvest.

14.3 You may retrieve and display the content on this website for your personal and non-commercial use only and in connection with any actual or proposed order by you on this website.

14.4 You may not link to this website or include this website in part or in whole within another external website without prior written permission.

15. Privacy Policy
15.1 Season Harvest is committed to protecting your privacy online. Names, addresses and email addresses are collected for order deliveries and from those wishing to join Season Harvest’s mailing list. Season Harvest will only use the information that Season Harvest collects about you lawfully and in accordance with 
the Data Protection Act 1998. Season Harvest’s data protection act registration number is (data protection number).

15.2 Season Harvest collect information about you for two reasons. To process your order and to provide you with the best possible service. Season Harvest will not disclose this information to any third parties without your written consent except for necessary delivery details in the case of a few suppliers who ship product directly to you. In the unlikely event Season Harvest need to transfer your information outside the EEA (European Economic Area) Season Harvest  will always obtain your consent first.

15.3 The information Season Harvest will collect about you is only that supplied during the process of ordering from Season Harvest whether by phone, mail-order or website.

15.4 The information Season Harvest hold will be kept accurate and up to date. It is held securely in accordance with Season Harvest’s internal security policy, the law and the SafeBuy code of practice.

15.5 You can check the information that Season Harvest hold about you by emailing Season Harvest on (sales@seasonharvest.co.uk). If you find any inaccuracies Season Harvest will delete or correct it promptly. Please email any changes to (sales@seasonharvest.co.uk).

15.6 Season Harvest do not send random marketing emails to personal email addresses (spam). Season Harvest will not e-mail you in the future unless you have given Season Harvest your consent. Season Harvest do not pass on your email address to any third parties. You can remove your name from Season Harvest’s email list by contacting Season Harvest on (sales@seasonharvest.co.uk).

15.7 Season Harvest may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

16. Disclaimers
16.1 This section (and any other clause excluding or restricting our liability) applies to diectors, officers, employees, subcontractors, agents and affiliated companies of Season Harvest as well as to Season Harvest. Nothing in this agreement in any way limits or excludes the liability of Season Harvest for negligence causing death or personal injury or for fraudulent misrepresentation or for anything which may not legally be excluded or limited.

16.2 Without prejudice to the rest of these T&Cs, Season Harvest’s liability of any kind including breach of contract, tort (including negligence) or otherwise with respect to this website or any goods purchased via this website shall be limited to the amount of any order to which the claim relates or £300, whichever is higher.

16.3 In no event (including our own negligence) will Season Harvest be liable for any:

16.3.1 Economic losses (including, without limit, loss of revenues, profits, contracts, business or anticipated savings);

16.3.2 Loss of goodwill or reputation;

16.3.3 Special, indirect or consequential losses; or

16.3.4 Damage to or loss of data (even if Season Harvest has been advised of the possibility of such losses) with respect to this website.

17. General
17.1 These T&Cs constitute the entire agreement between you and in connection with the use of this website. Any failure by Season Harvest to exercise or enforce any right or provision of these T&Cs shall not constitute a waiver of such right or provision. If any part of this agreement is deemed ineffective for any reason, the remainder shall continue in full force. A person who is not a party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement save in relation to disclaimer part 1.

18. Jurisdiction
18.1 This contract shall be governed by the laws of Northern Ireland and any disputes will be decided only by the courts of Northern Ireland. 

19. Force Majeure 
19.1 Season Harvest are not liable for failure to perform or delay in performing any obligation (excluding payment) under this agreement if the failure or delay is caused by any circumstances beyond our reasonable control.
